Thank you for using Aksi! The terms of use cover your use and access to our services. The terms of use consist of two inseparable documents: Terms of Use and Privacy Policy, both of which are available on our website. For more detailed information about the privacy and security of our services, check the Privacy Policy document. The Aksi service is provided for you by Insight Technology d.o.o. (data controller for your personal data).
Our cloud service is a digital assistant that helps you fill out the European accident report in case of a traffic accident and document the damages and circumstances for the fastest possible damage reporting to the insurance company. It also allows the exchange and storage of documents and images that you provide when preparing the European accident report or later in the process of reporting and claiming a damage case with the insurance company and communication between all stakeholders.
By using our services, you agree to be bound by these terms of use. Occasionally we may make changes to our services without prior notice. Although we strive to ensure that the services run smoothly, just like any other service or software, we cannot guarantee that Aksi will always operate uninterrupted or that it will be immune to errors or bugs. In such cases, we will do everything possible to fix things immediately, but we cannot guarantee that this will always be possible.
Aksi is free for users. Insurance companies pay for access to data according to commercial terms.
By using the Aksi service, you voluntarily consent to the collection, processing, transfer, and use of your personal data in accordance with these terms of use.
For the best user experience within Aksi, we also use third-party tools where there may be an exchange of personal, business, or anonymized information. We only work with third parties who have published a privacy policy that governs the collection, storage, processing, and use of personal and business information in accordance with the GDPR directive. Such service providers include, without limitation and subject to change, Amazon Web Services (AWS), Microsoft Azure KeyVault, Fabric, Sentry, Regula, OpenAI, Mixpanel, NetResults, Zendesk, MailChimp, Appsflyer, and Google Analytics. Please read their terms of use and privacy policies to better understand their privacy practices.
As long as you adhere to these terms of use, we grant you a personal, non-exclusive, non-transferable, and fully revocable license to use Aksi for your own use.
You are solely responsible for your behavior and your data in relation to our services. You agree to defend and indemnify Aksi and its suppliers from any loss, cost, liability, and cost arising from or related to your data, your use of our services, or violation of these terms. Our services are available to you only for personal or internal business use, which must be in accordance with all applicable laws, rules, and regulations and must not violate the rights of third parties. Our services may not be commercially exploited, including, but not limited to, the sale or distribution of our services to third parties.
If you accept these terms on behalf of an organization or entity, you represent and warrant that you have the authority to accept these terms on behalf of the organization or entity and bind them to these terms (in which case references to "you" and "your" in these terms refer to that organization or entity). You will use the services only in a manner that is in accordance with all laws applicable to you.

Any violation of any of the above conditions is grounds for termination of your right to use or access our services. Any unauthorized use of any Aksi service constitutes a violation of these terms and such violations may expose the unauthorized user and his agents to civil and criminal sanctions.
We are constantly striving to improve our services, so these terms may change from time to time. We reserve the right to change the terms at any time. When we do, we will update the date to make it clear that a new version has been created. In the Aksi service, there is always a link to the current version of these terms. If you do not agree with the new terms, this unfortunately means that you will no longer be able to use our services. Continued use of the services after the entry into force of the change in terms means that you agree to any change in the terms.
As a user, you can stop using our services at any time. The insurance company can stop using the service in accordance with commercial terms. We reserve the right to withhold or terminate services at any time at our discretion and without notice (e.g., if you do not comply with these terms of use).
To the maximum extent permitted by law, our services are provided "as is" and Aksi, including its agents, owners, subcontractors, directors, employees, affiliates, and suppliers (collectively Aksi agents), disclaim all warranties of any kind. You agree that your use of our services is entirely at your own risk.
To the maximum extent permitted by law, Aksi or its agents are in no case liable for any damage or loss, including, but not limited to, direct, indirect, special, punitive, incidental, or consequential damage. This includes, without limitation, loss of data, goodwill, profit, or business interruption, regardless of whether Aksi or its agents have been informed of the possibility of such damage.
The total liability for any damage arising from these terms of use by Aksi or its agents will be limited to the greater of the amounts of payments you have paid for use to Aksi, or 1.00 EUR.
If Aksi fails to enforce these terms, this does not waive its right to do so later. If it is found that a provision is unenforceable, this provision will be limited or removed to the smallest possible extent, so that these terms of use will otherwise remain in full force and effect and most closely approximate the expressed intent. Without our prior written consent, you may not assign or transfer any rights or obligations under these terms of use and any attempt to do so will be void.
These terms of use are interpreted in accordance with the law applicable in the EU.
